Version 1 — 2 November 2026

Preamble

These general terms and conditions of sale (hereinafter the ‘GTC’) govern the contractual relationship between the company Cimes et Horizon, a simplified joint-stock company (SAS) with a share capital of €10,000, whose registered office is situated at 1 place Marie Curie, 74000 Annecy, France, registered with the Annecy Trade and Companies Register under number 108 246 273, hereinafter ‘the Agency’, and any individual making a booking or purchasing a holiday from the Agency, hereinafter ‘the Customer’.

  • Registration in the register of travel and holiday operators with Atout France: IM074260015
  • Financial guarantee: Accelerant Insurance Europe SA, Place du Champ de Mars 5, 1050 Bruxelles, Belgique
  • Professional Indemnity Insurance: Accelerant Insurance Europe SA, Place du Champ de Mars 5, 1050 Bruxelles, Belgique (policy no. CL-AIE-2026-00029)

The purpose of these GTC is to inform the Customer, prior to the conclusion of the travel sales contract, of the general framework of the services offered, the booking and payment procedures, the conditions for amendments and cancellations, the insurance offer, and the rights and obligations of each party. Any booking of a trip with the Agency implies the Customer’s full and unconditional acceptance of these GTC.

The applicable version of the GTC is that in force on the date of booking. The Agency reserves the right to amend or update its terms and conditions at any time; such amendments shall apply to bookings made after their publication on the website.

1. Description of trips

Cimes et Horizon is a French travel agency specialising in treks, mountaineering courses and climbs in Nepal, offered in exclusive partnership with its local partner, a Nepalese incoming agency founded and managed by certified professional guides.

The trips on offer are package holidays within the meaning of Article L.211-2 of the French Tourism Code and Directive (EU) 2015/2302. These are customisable trips, tailored to each Customer’s ability, schedule and ambitions, ranging from accessible trekking routes to very high-altitude expeditions.

The destination for these trips is Nepal. Their duration varies from a few days to several weeks, depending on the chosen itinerary.

2. Transport, accommodation, meals and guidance

The package does not include international air travel between the Customer’s country of departure and Kathmandu, Nepal. Our local partner will look after the Customer from their arrival at Kathmandu Airport, Nepal, until their departure from the same airport, unless otherwise specified in the itinerary.

As the international flight is at the Customer’s own expense and of their own choosing, they undertake to provide the Agency with a copy of their flight booking (outbound and return) no later than when the balance of the trip is paid, in order to enable the organisation of airport transfers and coordination with our local partner. It is the Customer’s responsibility to check that their flight times are compatible with the dates of the programme; the Agency cannot be held liable for any discrepancy between the flight booked by the Customer and the travel itinerary.

Depending on the itinerary, the package may include:

  • airport transfers in Kathmandu;
  • accommodation in a lodge (trekking lodge) or camp (tent), depending on the nature of the trip;
  • full board during the trek or expedition;
  • the services of a certified guide, either French-speaking or English-speaking depending on availability as indicated at the time of booking, as well as the necessary team of porters;
  • the trekking and climbing permits required by the Nepalese authorities;
  • domestic flights within Nepal or road transfers where the itinerary requires it.

The following are excluded from the package, unless otherwise stated: the international flight from Paris (or another departure city) to Kathmandu, travel assistance, repatriation and cancellation insurance, the entry visa for Nepal, personal expenses, drinks and tips, as well as any services not explicitly mentioned in the trip description.

Prior to the conclusion of the contract, the Agency shall provide the Customer with a detailed programme specifying the route, dates, required fitness level, accommodation, catering and guidance arrangements, the language (French or English) in which the tour will be conducted, and the minimum number of participants required for guided group tours (the conditions applicable in the event of an insufficient number of participants are set out in clause 6.2).

Given the physical and technical demands of the treks and climbs offered in high-mountain environments, the Agency’s trips are not designed to be accessible to people with reduced mobility. For any enquiries regarding the accessibility of a particular trip, the Customer is invited to contact the Agency before booking.

3. Prices and booking terms

3.1 Prices

The prices shown on the Agency’s website, in quotations and in brochures, are quoted in euros, inclusive of all taxes. They are per person, unless otherwise stated. They include the services described in Article 2 and are guaranteed to the Customer upon confirmation of their booking.

3.2 Booking

Any booking is considered firm and final upon receipt by the Agency of the booking form (or online order confirmation), a copy of the Customer’s valid passport, and payment of the deposit specified in Article 3.3. In accordance with Article L.211-10 of the Tourism Code, the Agency shall send the Customer a confirmation of their contract on a durable medium (email), setting out all the pre-contractual information provided.

Given the level of physical exertion required by the trips on offer, the Customer undertakes, prior to registration, to inform the Agency of any specific health conditions, ongoing medical treatment or circumstances (disability, being under guardianship or curatorship) that may affect their participation or the smooth running of the trip. The Agency reserves the right to assess, in light of this information and the level of physical ability required for the chosen trip, whether or not the Customer can be booked on the trip.

3.3 Payment terms

  • A deposit of 30% of the total price of the trip is payable upon confirmation of the booking.
  • The balance, i.e. 70% of the price, is payable no later than 30 days before the departure date.
  • For any booking made less than 30 days before departure, the full price is payable at the time of booking.

Payment may be made by bank transfer or credit/debit card in accordance with the terms specified by the Agency.

3.4 Price Revision

In accordance with Article L.211-13 of the Tourism Code, the price may be revised, either upwards or downwards, up to 20 days before departure, to take account exclusively of changes in:

  • transport costs linked to fuel prices;
  • charges and taxes applicable to the services (landing charges, entry or exit taxes);
  • exchange rates applied to the trip, insofar as part of the services invoiced to the Agency by its local partner are invoiced in a foreign currency.

If the resulting price increase exceeds 8% of the total price of the trip, the Customer may terminate the contract at no cost, in accordance with Article 8. The Customer’s refusal to pay a price adjustment in accordance with this Article shall be deemed a cancellation on their part, and the cancellation fees set out in Article 5 shall apply.

4. Administrative and health formalities

The following information applies solely to French nationals; nationals of other countries are advised to check with the relevant authorities.

All French nationals must be in possession of a passport valid for at least 6 months after the scheduled return date, as well as a tourist visa. This visa can generally be obtained on arrival at Kathmandu airport, upon presentation of a passport photograph (photographs can be taken on site) and payment in cash (US dollars or euros). Visa regulations are subject to change; the Agency advises the Customer to consult the ‘Nepal’ information sheet on the website of the Ministry for Europe and Foreign Affairs (France Diplomatie) before departure, and to refer to it regularly for any information regarding security and health risks in the country.

Obtaining a visa is the Customer’s responsibility. The Agency cannot be held liable in the event of a visa refusal.

The Agency also advises the Customer to consult, before departure, the health and vaccination recommendations for Nepal available on the Institut Pasteur website, or to seek medical advice. Compliance with the required vaccination and medical formalities, as well as the associated costs, is the sole responsibility of the Customer.

5. Cancellation terms and fees

5.1 Cancellation by the Customer

In accordance with Article L.121-21-8 of the French Consumer Code, the Customer does not have a right of withdrawal for the purchase of tourist services.

Any cancellation must be notified to the Agency in writing, with acknowledgement of receipt, as soon as the event giving rise to the cancellation occurs. The date of cancellation shall be deemed to be the date on which the written request is issued.

Certain services are booked in the Customer’s name with the Agency’s local partners (domestic flights within Nepal, visas, and trekking and climbing permits). Once issued or firmly booked, these services are payable in full at their actual cost and are non-refundable in the event of cancellation. Their cost is deducted from the total price of the trip before the scale below is applied.

The balance of the trip price, once this cost has been deducted, is refunded after deduction of the following cancellation fees:

Time before departure Fee deducted
More than 60 days 20%
60 to 31 days 30%
30 to 15 days 60%
15 to 8 days 80%
Less than 8 days 100%

All cancellation fees are payable to the Agency regardless of any cancellation insurance the Customer may have taken out elsewhere; the terms and extent of any reimbursement of these sums by the insurer are governed exclusively by the contract between the Customer and their insurer.

5.2 Cancellation by the Agency

In accordance with Article L.211-14 of the Tourism Code, the Agency may terminate the contract if it is prevented from performing it due to exceptional and unavoidable circumstances. The Customer shall then be informed as soon as possible before the start of the trip, and all sums paid shall be refunded to them without them being entitled to any additional compensation.

6. Amendments to the travel contract

6.1 Amendments by the Agency

Once the contract has been signed, the services, prices and itineraries set out in the programme may only be amended due to circumstances beyond the Agency’s control or in the event of force majeure, in particular for safety reasons (weather conditions, local health or political situations). In such cases, the Agency shall offer the Customer a replacement service of equivalent quality or, failing that, shall refund the corresponding amounts.

If a key element of the trip, other than the price, undergoes a significant change prior to departure, the Customer may terminate the contract at no cost and obtain a full refund of the sums paid.

6.2 Conditions for group travel

In accordance with Article L.211-14 of the Tourism Code, the operation of guided group tours is subject to a minimum number of participants, as specified in the technical details for each tour. If this number is not reached, the Agency shall inform the Customer no later than:

  • 20 days before departure for tours lasting more than 6 days;
  • 7 days before departure for trips lasting between 2 and 6 days;
  • 48 hours before departure for trips not exceeding 2 days.

The Customer may then choose either to accept an alternative solution proposed by the Agency, to defer their booking to a future departure, or to cancel with a full refund of the sums paid, without any additional compensation.

6.3 Changes requested by the Customer

Any request for changes (addition or removal of services) made by the Customer after booking is subject to the Agency’s approval and to any associated costs, which must be paid by the Customer. If payment is not made, the Agency is under no obligation to carry out the requested changes.

After the departure date, any changes initiated by the Customer shall entail payment for the new services as well as, where applicable, cancellation fees, unless such changes are expressly provided for in the programme. The interruption of the trip at the initiative of a participant — including where their physical fitness is incompatible with the demands of the trek or climb — shall not give rise to any refund from the Agency.

7. Assignment of the contract

In accordance with Article L.211-11 of the Tourism Code, the Customer may assign their travel contract to a third party who meets the same conditions of participation, provided they inform the Agency in writing, with acknowledgement of receipt, no later than 7 days before departure.

The transferor and the transferee are jointly and severally liable for payment of the outstanding balance and any additional costs that may be incurred as a result of this transfer. However, insurance policies taken out are not transferable.

8. Traveller rights (Directive (EU) 2015/2302)

The combination of travel services offered to the Customer constitutes a package within the meaning of Directive (EU) 2015/2302, as transposed into Articles L.211-1 et seq. of the Tourism Code. As such, the Customer is entitled, in particular, to the following rights:

  • To receive all essential information about the package before the contract is concluded.
  • To benefit from the Agency’s full liability for the proper performance of all travel services included in the contract, including those provided by its subcontractors and local service providers.
  • To have an emergency number or a point of contact enabling them to reach the Agency at any time during the trip.
  • To transfer their package to another person, subject to reasonable notice and, where applicable, the payment of additional fees, in accordance with the terms of Article 7.
  • Not to have the price of the package increased less than 20 days before departure, and to benefit from a price reduction in the event of a fall in the costs that justified a price revision clause as referred to in Article 3.4. If the increase exceeds 8% of the total price, the Customer may terminate the contract.
  • To terminate the contract free of charge and receive a full refund if an essential element of the trip, other than the price, is significantly altered before departure, or if the Agency cancels the trip before it begins — with compensation where applicable.
  • To terminate the contract free of charge before departure in the event of exceptional and unavoidable circumstances at the destination that significantly affect the trip.
  • To terminate the contract at any time before departure, subject to payment of the appropriate and justifiable termination fees provided for in Article 5.
  • To receive suitable alternative arrangements, at no extra cost, if essential elements of the package cannot be provided as planned after the start of the trip, and to terminate the contract free of charge if the failure to perform significantly disrupts the trip and the Agency fails to remedy the situation.
  • To be entitled to a price reduction and/or compensation in the event of non-performance or poor performance of travel services.
  • To receive assistance from the Agency in the event of difficulties during the trip.
  • To be reimbursed, and where applicable repatriated if transport is included in the package, in the event of the Agency’s insolvency, thanks to the insolvency protection it has taken out with its financial guarantee body: Accelerant Insurance Europe SA, Place du Champ de Mars 5, 1050 Bruxelles, Belgique. The Customer may contact this body if services are refused on the grounds of the Agency’s insolvency.

The full text of Directive (EU) 2015/2302, as transposed into French law, is available at legifrance.gouv.fr.

9. Insurance

No insurance is included in the prices quoted by the Agency.

Given the nature of the activities on offer — trekking and high-altitude climbing — the Agency requires each Customer to take out comprehensive travel insurance prior to departure, in order to ensure the safety of its clients throughout the trip. This insurance must, without exception, cover:

  • the geographical area and maximum altitude of the booked trip;
  • search and rescue costs, up to a minimum of €10,000, whatever the medical reason, including acute mountain sickness;
  • emergency mountain helicopter evacuation, with a ‘Guarantee of Payment’ that can be directly accessed by a Nepalese helicopter operator, without any advance payment by the Customer, the Agency or its local partner;
  • medical and hospitalisation costs in the event of an accident or illness, including acute mountain sickness, up to a minimum of €30,000;
  • medical repatriation to the Customer’s home, at actual cost;
  • personal third-party liability cover for ‘sports accidents’, covering the activity undertaken (trekking, glacier walking, mountaineering or technical climbing, depending on the booked trip).

The Agency may refer the Customer to companies specialising in adventure and high-altitude travel insurance.

The Customer must provide the Agency with the relevant insurance certificate, together with the details of their policy (insurer, policy number, assistance number), and must provide the contact details of a relative to be contacted in the event of an emergency, no later than when the balance of the trip is paid.

This information enables the Agency, in conjunction with the on-site guide, to arrange assistance or liaise with the insurer if the Customer is unable to do so themselves. Apart from these situations, it is the Customer’s responsibility to contact their insurer directly, before or during the trip, to make any claim or arrange for assistance.

10. Liability

10.1 The Agency’s liability

The Agency is automatically liable for the proper performance of the travel services included in the contract, whether these are provided by the Agency itself or by its subcontractors and local service providers, in accordance with Article L.211-16 of the Tourism Code.

However, the Agency shall not be held liable for the consequences of the following events:

  • the Customer’s failure to produce the administrative, health or travel documents required to undertake the trip or cross borders, in accordance with the information provided by the Agency;
  • unforeseeable or unavoidable events caused by a third party: political unrest, strikes not attributable to the Agency, weather conditions, airspace closures, delays, loss or theft of luggage or personal effects;
  • any cancellation or alteration necessitated by exceptional and unavoidable circumstances, or by a requirement relating to the safety of travellers, including following a decision by an administrative authority or the local guide; in such cases, the Agency reserves the right to adjust the dates, times or itineraries of the trip in order to ensure the safety of participants, without any right of recourse on their part.

Where the Agency’s liability is engaged in respect of the actions of its service providers, the limits on compensation provided for by the applicable international conventions shall apply, in accordance with Article L.211-17-IV of the Tourism Code. Except in the case of personal injury, or damage caused intentionally or through negligence, the Agency’s maximum financial liability is limited to three times the total price of the trip.

The person making the booking in the name of and on behalf of other participants undertakes to pass on to them all the information provided by the Agency concerning the trip; the Agency shall not be held liable for any failure or omission in this transmission.

10.2 Nature of the activities and the traveller’s responsibilities

The Customer acknowledges that trekking and high-altitude mountaineering are sporting activities taking place in a demanding natural environment, involving inherent risks linked in particular to altitude, weather conditions and the remote nature of certain routes. The Customer declares that they have been informed of the physical and technical requirements for the chosen service, that there are no medical contraindications preventing them from taking part, and undertakes to comply with the safety instructions given by the guides of the Agency’s local partners.

The Customer further undertakes to:

  • provide accurate and up-to-date personal information;
  • ensure that their state of health is compatible with the booked trip;
  • bring the personal equipment required for the trek or climb, as described in the trip’s technical details;
  • arrive at the meeting points specified in the itinerary on the scheduled dates, taking into account the walking pace and departure times set by the guide;
  • take care of their luggage and personal belongings, for which they remain solely responsible at all times — the Agency cannot be held liable for their loss, theft or damage, particularly when they are transported by rudimentary means (porters, off-road vehicles) inherent to the Himalayan terrain;
  • to respect local customs, traditions and regulations;
  • to comply with the safety instructions and itinerary set by the guide, who is the sole authority on site to adapt or interrupt the programme depending on weather conditions, the state of the terrain or the physical fitness of the group;
  • never to separate from the rest of the group without the guide’s consent.

The Customer is advised, where possible, to bring a mobile communication device that can be used in the travel area and to provide the Agency with the relevant contact details before departure, in order to facilitate any emergency contact.

Should a participant’s behaviour endanger their own safety, that of the group, or significantly jeopardise the smooth running of the trip — including any act of verbal, physical, sexual or sexist violence — the on-site guide may decide to exclude them from the remainder of the programme. Such exclusion shall not give rise to any refund from the Agency, and the costs of early return shall be borne by the participant concerned. The Agency further reserves the right to refuse any future booking by that participant on any of its trips, without compensation in this regard.

11. Complaints and mediation

11.1 Complaints during the trip

Any non-compliance observed during the trip must be reported to the Agency without delay, using the emergency contact details provided in the travel booklet, so that the matter can be resolved on the spot where possible.

Failure to report the issue on the spot may be taken into account when assessing any potential price reduction or compensation, provided that immediate notification would have prevented or limited the loss.

11.2 Complaints after the trip

Any complaint must be submitted in writing to the Agency, accompanied by supporting documents, to the following address: Cimes et Horizon — 1 place Marie Curie, 74000 Annecy, or by email to contact@cimes-et-horizon.fr, within 30 days of the date of return.

11.3 Consumer mediation

In accordance with Articles L.611-1 and R.612-1 et seq. of the Consumer Code, if the Customer has submitted a written complaint to the Agency without receiving a response within sixty (60) days, or in the event of an unsatisfactory response, they may refer the matter free of charge to the relevant consumer ombudsman within a maximum of one year from the date of their initial complaint.

Ombudsman: CM2C, 49 rue de Ponthieu, 75008 Paris, France — telephone: 01 89 47 00 14 — online referral: https://www.cm2c.net/declarer-un-litige.php — email: litiges@cm2c.net

12. Personal Data

The personal data collected from the Customer is necessary for the processing of their booking and the proper execution of the trip, in particular in relation to their local partner and the relevant Nepalese authorities responsible for issuing trekking and climbing permits.

In accordance with the General Data Protection Regulation (GDPR) and the amended ‘Data Protection Act’ of 6 January 1978, the Customer has the right to access, rectify, erase, restrict and object to the processing of their personal data, which they may exercise by contacting the Agency at the address specified in Article 11.1. The Agency is responsible for processing the data thus collected, which is retained for the period necessary to fulfil the contract, plus any retention periods required by applicable legal, accounting and tax obligations.

For further details on the data collected, the purposes for which it is used and the exercise of these rights, the Customer is invited to consult the Agency’s privacy policy, available on its website.

13. Governing law and disputes

These GTC are governed by French law. In the event of a dispute, the parties shall endeavour to reach an amicable settlement, including through the mediation procedure provided for in Article 11.3. In the absence of an amicable settlement, the competent courts shall be those within the jurisdiction of the Agency’s registered office.
